Terms of Service

1. Acceptance of Terms
By accessing or using TradeHub, you agree to be bound by these Terms of Service and all applicable laws and regulations of South Africa. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.
2. Platform Description & Pilot Model
TradeHub is a discovery and connection platform for local products, services, tourism, and business opportunities in South Africa. During the current pilot phase:
- TradeHub facilitates discovery and connection between buyers and sellers
- Transactions may be arranged directly between users without platform intermediation
- Buyers are not required to register to browse listings or make contact enquiries
- The platform does not guarantee the completion of any transaction
- TradeHub reserves the right to evolve its model, including introducing managed checkout in future phases
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Sellers and listed participants must maintain accurate business information at all times and notify TradeHub of any material changes.
4. Participant Responsibilities
4.1 Sellers and Listed Businesses
- Provide accurate product and service descriptions
- Honour listed prices and stated terms
- Respond to buyer enquiries promptly
- Comply with all applicable South African consumer protection laws
- Maintain valid listings and remove outdated or discontinued offerings
4.2 Buyers and Enquirers
- Engage respectfully with listed businesses
- Verify product and service details directly with the seller
- Conduct due diligence before any direct transaction
- Report any misleading or fraudulent listings to TradeHub
5. Pricing, Fees and Charges
Introductory Access Period
TradeHub is currently operating in an introductory pilot phase where participants may access platform features at no cost. Fees and commissions may be introduced in future phases with reasonable prior notice.
TradeHub does not offer lifetime free access or permanent price lock-ins unless expressly confirmed in writing.
6. Prohibited Items and Activities
The following are strictly prohibited on TradeHub:
- Illegal goods or services
- Counterfeit, stolen, or misrepresented items
- Weapons, explosives, or controlled substances
- Fraudulent listings or misleading descriptions
- Hate speech or discriminatory content
- Data scraping, automated extraction, or reverse engineering of platform systems
- Any attempt to replicate, copy, or build competing systems using TradeHub's architecture or methodology
7. Intellectual Property Rights
7.1 Ownership of Platform
TradeHub is a proprietary platform operated by TradeHub Systems Africa. All intellectual property rights associated with the platform — including its systems, architecture, design, functionality, processes, methodologies, frameworks, and underlying concepts — are owned by Bizvise (Pty) Ltd and licensed to TradeHub Systems Africa for operation and commercialisation.
7.2 Scope of Protection
Intellectual property protection covers:
- Platform architecture and system design
- Marketplace structure and interaction models
- Economic intelligence systems and frameworks
- Integration of trade, certification, and intelligence layers
- UI/UX design, branding, and content
- Databases, data structures, and analytical models
7.3 User Restrictions
Users may NOT:
- Copy or reproduce platform elements, systems, or workflows
- Reverse engineer any component of the platform
- Replicate the TradeHub model or its underlying methodologies
- Scrape, extract, or export data from the platform
- Build competing platforms using TradeHub's logic, frameworks, or data
7.4 Limited Licence
Users receive a limited, non-exclusive, non-transferable licence to use the platform solely for its intended purpose of discovery, listing, and connection. This licence does not extend to any commercial reproduction or replication of platform components.
7.5 Data Ownership
TradeHub retains all rights to aggregated, system-generated, and platform-derived data. Individual user-submitted content remains the property of the submitting party, subject to the licence granted in the Data Usage clause below.
7.6 Enforcement
TradeHub may suspend access, remove listings, and pursue civil or criminal legal action for violations of this clause without prior notice.

This clause survives termination of your account or these Terms of Service.
8. Data Usage, Rights, and Protection
8.1 Data Collection
TradeHub collects the following categories of data:
- Personal and contact information provided during registration or submission
- Business and listing data submitted to the platform
- Platform interaction data (browsing, enquiries, engagement patterns)
8.2 Purpose of Data Use
Collected data is used to:
- Enable connections between buyers, sellers, and participants
- Improve platform performance and user experience
- Generate aggregated economic intelligence and sector insights
- Support local economic development, investment readiness, and policy outputs
- Communicate relevant opportunities and platform updates
8.3 Aggregated Economic Intelligence
TradeHub may aggregate and anonymise data to produce market insights, sector analysis, geographic trend reports, and economic intelligence outputs. All such outputs remain the exclusive property of TradeHub Systems Africa and Bizvise (Pty) Ltd.
8.4 User Content Licence
Users retain ownership of content they submit. By submitting content, you grant TradeHub a non-exclusive, royalty-free licence to display, promote, and analyse such content for platform and economic development purposes.
8.5 Data Sharing
Data may be shared:
- Between platform participants for connection purposes (as intended by users)
- With verified economic development partners in anonymised or aggregated form
- When required by South African law or regulatory authority
TradeHub does not sell personal information to third parties.
8.6 Data Protection
TradeHub applies reasonable technical and organisational safeguards to protect user data. Full details are set out in the Privacy Policy.
8.7 User Data Restrictions
Users may NOT:
- Scrape or extract data from the platform by automated or manual means
- Reuse platform data for commercial purposes outside of the platform
- Replicate database structures or data models
8.8 POPIA Compliance
TradeHub complies with the Protection of Personal Information Act, 4 of 2013 (POPIA). Users have the right to access, correct, or request deletion of their personal information. See the Privacy Policy for full details.
8.9 Future Systems
Data collected on the platform may be used in future to power intelligence dashboards, certification systems, investment readiness tools, and related economic infrastructure — always in compliance with POPIA.
8.10 Survival
This clause survives termination of your account or these Terms of Service.
9. Dispute Resolution
Buyers and sellers are encouraged to resolve disputes directly. If resolution is not possible, either party may request TradeHub's mediation. In cases involving platform misuse or IP violation, TradeHub's decision is final and binding, and legal remedies may be pursued without prior mediation.
10. Limitation of Liability
TradeHub is not liable for any indirect, incidental, or consequential damages arising from your use of the platform, including any loss arising from direct buyer-seller transactions arranged outside the platform's managed systems. Our maximum liability is limited to fees paid in the 12 months preceding the claim, or R1,000 — whichever is greater.
11. Termination
We may terminate or suspend your account at any time for violation of these terms, misuse of the platform, or at our discretion. Upon termination, your right to use the platform immediately ceases. Clauses 7 (Intellectual Property) and 8 (Data Usage) survive termination.
12. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
